Privacy Policy
This document establishes the policy of PaySolve with respect to how we gather, process, store, share and communicate your personal data. It is established between users of our Services (you, your, yours, yourself) and PAYSOLVE PTY LTD ACN 676 887 648 (we, us, our, ours, ourselves).
For the purposes of this document:
- The term Merchant means an entity that has a Merchant Account for the purposes of issuing Invoices.
- The term Payor means an entity, whether it has a Payor Account or not, that interacts with our Services with the intent of paying or obtaining information about one or more Invoices, or for creating a Redress object.
Types of Services covered by this document
This document relates only to the services (the Services) of PaySolve that do not include the services and facilities made available to Merchants. These Services include:
- The Payor facilities such as the display and interaction with Invoice and Series objects by Payors.
- The ability to create email-specific description codes for Invoice payments.
- The ability to create and enjoy the services of a Payor Account.
- The ability to create Redress objects.
- The issuance of various communications to our users in relation to our Services.
- The matching of bank account transfers received by our Merchants’ bank accounts to Invoice objects.
This document does not include the privacy policies with relation to data collected for a Merchant Account. The provisions governing data collected in relation to a Merchant Account are governed by the Merchant Agreement.
Types of Data we collect, process, store and share
By using our Services, you agree that the following data is collected by us:
- Cookie data to identify you in a session on your browser, whether to authenticate a Payor Account, or for other purposes as described in this document.
- Identity information including name, email and password hashes, if you so provide them in the course of creating a Payor Account.
- Saved associations with Invoice and Series objects that you make if you have a Payor Account.
- Invoice-email associations by generating special description codes for email-specific associations between bank account transactions and Invoice objects.
- Bank transaction information from bank transactions you make to credit the bank accounts of Merchants, obtained pursuant to an Open Banking consent created by the Merchant under the Consumer Data Right Act of 2019 (Cth), including the amount, time of transaction, and description.
How we collect and store your data
We collect your data either by you providing it to us via the Internet by interacting with our Services, or by obtaining information from the Merchant’s bank account about transactions that you may have made to that account. In the latter case, this is done by a Consumer Data Right consent made by the Merchant pursuant to the Consumer Data Right Act of 2019 (Cth).
Your data is encrypted at rest in a database, and all passwords are stored by strong hashing algorithms.
Your data may be stored and processed in databases and servers overseas.
Purposes for which we use your data
The purposes for which we use your data are:
- To facilitate the provision of the Services, and to enhance your experience, security and satisfaction with the Services.
- Provide accurate information and quality experience to Merchants and other users with whom you interact.
- To understand patterns of user behaviour to improve and develop our products.
We endeavour to make reasonably available an opportunity for you to amend your personal data where you believe it is erroneous.
Third parties with whom we share your data
We only share your data to third parties in the following circumstances:
- Your data is stored on third-party databases and is processed on third-party servers and platforms but is inaccessible to any third party.
- When a transfer by you is matched to an Invoice object, we provide that information to the Merchant whose Invoice was matched.
- When a Redress object is submitted by you, the information submitted is made available to the Merchant whose bank account you identify as being credited.
- We may take statistical data across the userbase and securely share it with a third party for the purpose of statistical analysis.
- We will avail data to any third party if required to do so by law, regulation, warrant or subpoena.
- We will provide data to an appropriate law enforcement body if we believe a criminal offence has been committed.
- In the event of an actual or prospective acquisition of equity of our company, we may avail certain data necessary to inform the prospective party under the appropriate safeguards to prevent further disclosure.
We do not share your data to any third party for the following reasons:
- So that a third party may communicate marketing, spam or harassment to you.
- To any Merchant for the purpose of assisting the collection of any debt, unless required to do so by law or subpoena.
Requesting deletion of your data
We agree to delete Payor Accounts and associated information if requested to be deleted by you. We must maintain records of banking transactions even if you request their deletion to maintain a high quality of record keeping.
Complaints and dispute resolution
Any complaints about the handling of data should be first made to us by contacting us at [email protected]. If the complaint cannot be resolved, you can contact the Australian Privacy Commissioner.
Amending this document
We reserve the right to amend this policy document. All amendments will be made public and communicated to users in a prompt transparent manner.
